    Welcome to Holistic Performance Limited trading as Coached by Cliff. These Terms and Conditions govern your use of the Coached by Cliff website and all services provided. By accessing or using our website, programs, or coaching services, you agree to be bound by these Terms.
  2. Services Provided
    Coached by Cliff provides a range of health and wellness services, including online programs, e-books, and personalized health, nutrition, and strength coaching.
  3. User Obligations
    By using our services, you agree to:
    • Provide accurate and truthful information.
    • Use the services only for lawful purposes and in accordance with these Terms.
    • Be respectful and not engage in any conduct that is harmful, harassing, or discriminatory.
  4. Intellectual Property Rights
    Coached by Cliff retains all intellectual property rights to its content, including all online programs, e-books, coaching materials, and website content. All content is protected by copyright and other intellectual property laws.
    You are granted a limited, non-exclusive, non-transferable license to use the programs and resources for your personal, non-commercial use only. You may not, without prior written consent:
    • Share, distribute, or resell any content.
    • Reproduce, modify, or create derivative works from the content.
    • Use the content for any commercial purpose. An exception is made for content explicitly marked as free for distribution.
  5. Payments & Refunds
    All payments are processed via credit card. Our services are offered on a one-time purchase or subscription basis, as specified for each service.
    • E-books and One-Off Programs: We offer a money-back guarantee for all e-books and one-off programs.
    • Subscriptions: Refunds for subscriptions are available within 30 days of the initial purchase. All refunds are subject to these terms.
  6. Consultation Rescheduling & No-Show Policy
    All consultation fees are non-refundable. However, you may reschedule a consultation if you provide more than 2 working days’ notice. In the event of a “no-show,” where you are more than 15 minutes late without prior notice, the consultation will be forfeited, and no refund will be issued.

    The information and services provided by Coached by Cliff are for informational and educational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or a qualified healthcare provider with any questions you may have regarding a medical condition.   8. Limitation of Liability
    You agree that Coached by Cliff shall not be liable for any direct, indirect, incidental, or consequential damages or losses arising from the use of its services. We provide our services on an “as-is” and “as-available” basis, and we do not guarantee any specific results. You use our services at your own risk.
  9. Termination of Access
    We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users or our business interests.
  10. Governing Law
    These Terms shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of that jurisdiction.
  11. General Provisions
    These Terms constitute the entire agreement between you and Coached by Cliff regarding the use of our services. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in effect.
